As we all know, it is a full documentation lending world these days. Aside from the "known" paperwork required to even get pre-approved, there are some other items that prospective homebuyers should be ready to provide once they are actually in escrow.
Credit Card Information for the Appraisal Order: For Conventional and FHA loans, appraisals are ordered online through appraisal management companies' websites and must be paid at time of ordering. Real estate agents may also pay for their client's appraisal, but a credit card will still be required. VA appraisals are ordered directly through the VA and are charged to the buyer at closing.
Proof Earnest Money Deposit Cleared Account: Once the initial deposit clears the buyer's bank account, a copy of the cancelled check as well as an updated balance statement from that account will be required. These funds can also be wired, but a post-transfer balance will still be needed.
Homeowners Insurance Quote: Homeowners insurance is part of the housing expense and is therefore factored into the debt to income ratios. Having an accurate quote as early as possible in the transaction is helpful. Remember that "walls in" coverage is now required on all condominiums as well, known as an HO6 policy.
Letters of Explanation: If not already handled in the pre-approval process, buyers will need to explain any derogatory credit (no matter how old), any credit inquiries within the past 90 days and if they resulted in new accounts, any larger than normal bank deposits, job gaps, etc.
Gift Letter and Source of Funds of the Gift: Whenever the buyer is receiving a gift for the down payment and or closing costs, the donor must complete a gift letter and also provide a recent asset statement to source the gift. Some donors are reluctant to provide copies of their bank statements which can sometimes cause delays.
Updated Paystubs and Asset Statements: All income/asset documentation must be dated within 30 days of funding. Exceptions are quarterly asset statements. Also, online bank printouts are typically unacceptable unless they show the full account number and account holders name.
By the way, you may have heard about Fannie Mae's Loan Quality Initiative which is yet another effort to reduce loan defaults. Lenders are now required to monitor a borrower's credit throughout the transaction to make sure no new accounts are opened during escrow. A "soft" credit inquiry will be pulled at time of underwriting and any new accounts, or even any additional inquiries after the lender's initial inquiry, will need to be explained. Do not buy a new car while trying to buy a home!
I discuss the above items with every client, but it never hurts for them to hear it from someone else, namely their trusted real estate agent!

FHA purchase - initial application taken on 4/5/2011, buyers purchased a short sale, seller's lender approved the short sale on 3/2/2012, but the short sale approval was only good until 3/16/2012. We closed the loan on 3/15/2012.
CONV purchase - client was working with another lender and was 47 days into a 30 day escrow when they called me. We closed in 2 weeks.

The HARP Deal 2.0 - We often hear the term "owner occupancy ratio" which refers to the percentage of condominium owners that actually occupy their units in a condo project. The idea is that the lower the owner occupancy ratio, the greater the chance of a condo project going under.
Why? Because when hit with a financial hardship, a homeowner is more likely to stop paying the mortgage on a property in which they do not live vs. good ol' Home Sweet Home.
As I have stated in a previous post, Less Than 51% Owner Occupancy? OK For Conventional Loans, Fannie and Freddie do not care about the owner occupany ratio IF the home is a Principal Residence or a Second Home. The same goes for the HARP Deal 2.0. However, mortgage insurance companies (PMI) have their own overlays, anywhere from a 51% to 75% owner occupancy requirement.
The HARP Deal 2.0 does follow Fannie/Freddie guidelines for Investor owned condos, i.e., the owner occupancy ratio must be at least 51%.

The HARP Deal 2.0 - One thing to keep in mind for the HARP Deal 2.0 is that the new loan amount may exceed the "regular" Conforming limit of $417,000 for many California properties.

Assuming you meet all of the other criteria (click HERE to read the main guts of the HARP Deal 2.0), occupancy does not affect eligibility.
Will an Investment Property loan under the HARP Deal 2.0 cost a little more? Yep. But if you are currently stuck at 5%, 5.5%, 6% or more, dropping down into the 4's is probably going to help with cash flow. Or, refinance the HARP Deal 2.0 to a shorter term and lower the rate even more.

The HARP Deal 2.0 - Are you underwater in San Diego County California? One of the main changes with the HARP Deal 2.0 is that loan to value (LTV) no longer matters.
What is loan to value? Loan to value is your loan amount divided by the value of the home. Previous versions of the HARP Deal capped this at 105% and 125%. This was still not enough for many underwater San Diego County California homeowners.
Great news! If you purchased your San DiegoCounty California home prior to June 1st, 2009, you may qualify for the HARP Deal 2.0. This applies to Primary residences, 2nd homes, and investment properties.

Verify whether or not your San Diego County California home loan is owned by Fannie Mae or Freddie Mac
Are you current on your San Diego County California mortgage? Fannie Mae will not allow any 30-day late payments in the previous 12 months. Freddie Mac will not allow any 30-day late payments in the last six months, but will allow one in months 7 to 12.
Not current? Get current. The HARP Deal 2.0 is going to run through December 31, 2014, so you hopefully have enough time to get your San Diego County California loan current and stay current.

One of the main requirements of the HARP Deal 2.0 is that the loan must have been closed and delivered to Fannie Mae (FNMA) or Freddie Mac (FHMLC) prior to June 1, 2009. There are no exceptions to this requirement to qualify for the Fannie DU Refi Plus or the Freddie LP Open Access. As stated in a previous post, The HARP Deal, Does Your Loan Qualify?, not only does your loan need to be owned by Fannie or Freddie, but:
the loan must not be in default (additional credit requirements apply)
the loan can not be a Government loan (FHA, VA, USDA, etc.)
the loan can not be a Reverse Mortgage
the loan must be a 1st lien
If your loan does not meet the above criteria, then unfortunately you do not get to "pass go" for the HARP Deal 2.0. However, if none of the above apply to your loan, the next step is to check the Fannie and Freddie "look up" sites:

We have all heard the rumors over the last few months that the Federal Housing Administration (FHA) planned to increase their mortgage insurance premiums, but no one really knew when.
The Upfront Mortgage Insurance Premium (UFMIP), typically financed, will increase from 1.0% of the base loan amount to 1.75% of the base loan amount. On a $300,000 purchase price, this increase will affect a borrower's monthly payment by about $10 per month at today's interest rates.
FHA will also be increasing the Annual Mortgage Insurance Premium (MIP) which is paid monthly by 0.10% for all FHA insured loans with FHA case numbers assigned on or after April 9, 2012. There will be an additional 0.25% increase (a total of 0.35% over current levels) for loans greater than $625,500 with FHA case numbers assigned on or after June 1, 2012.
Assuming that interest rates stay at similar levels, how will the MIP increase affect a borrower's payment? Here are a couple examples:
Purchase price $200,000 with new UFMIP and MIP - increase of $23 per month
Purchase price $300,000 with new UFMIP and MIP - increase of $34 per month
Purchase price $400,000 with new UFMIP and MIP - increase of $46 per month
Purchase price $500,000 with new UFMIP and MIP - increase of $57 per month
Purchase price $600,000 with new UFMIP and MIP - increase of $69 per month
For High Cost Areas like San Diego County where FHA insured mortgages are allowed up $697,500 ($729,750 in other parts of CA), the additional increase after June 1st will have the following effects:
Base loan amount $625,500 (purchase price of about $648,186 with 3.5% down payment) with new UFMIP and MIP - increase of $204 per month
Base loan amount $697,500 (purchase price of about $722,797 with 3.5% down payment) with new UFMIP and MIP - increase of $228 per month
Base loan amount $729,750 (purchase price of about $756,217 with 3.5% down payment) with new UFMIP and MIP - increase of $239 per month
According the FHA's Carol Galante, "the mortgage insurance premium changes will enable FHA to increase revenues at a time that is critical to the ongoing stability of its Mutual mortgage Insurance (MMI) Fund, contributing more than $1 billion to the Fund, based on current volume projections through Fiscal Year 2013."
IMPORTANT REMINDER: These changes are for properties with FHA Case numbers assigned on or after April 1st (and June 1st for larger loans). The changes do not affect loans with FHA Case numbers assigned prior to April 9th, 2012.

Encinitas CA - Many people that live in Southern California have some sort of emergency disaster kit stashed away in their garage. A typical kit may include drinking water, some can goods, flashlight, batteries, candles, medications, etc.
As a homebuyer, you should prepare your loan paperwork the same way and have all items ready in case of a loan emergency. Even though you provided your lender with the items necessary to process your loan, it is a good idea to keep a "shadow file" or Loan Emergency Kit just in case something gets misplaced...or the copier eats the only copy your lender had of your last paystub, W-2, you name it.
That credit card late payment or mortgage late payment you had removed last year might show up again. Do you have the letter from the creditor handy? What about your landlord from a year ago. Do you still know how to contact them?
Here are some other items to keep in your Loan Emergency Kit:
Proof judgments and/or tax liens have been paid.
Copy of divorce decree and/or child support order.
Paperwork regarding length of time a student loan is deferred.
If retired, awards letters for social security or pensions.
Quarterly asset statements (401k's for example).
Receipts or canceled checks for rent payments. More and more lenders are requiring this type of proof of payment if the landlord is a private individual.
Bankruptcy papers including list of creditors and the discharge paper. If your lender did not ask for these at the beginning of the process, chance are that they will need them at the end.
Tax returns with all schedules.
W-2's.
Paystubs and bank statements - save them all until the deal is closed.
Getting a call at the 11th hour from your lender requesting something you have already provided can be extremely frustrating. Sure, you could stomp your feet in anger and really give your lender a piece of your mind.
You could spend a few extra days thinking of ways to cause them the same emotional stress that they are causing you. Or, you could just re-fax or re-email the missing item. Remember, you are dealing with people and all people, including you, make mistakes.
Is there any excuse for these occurrences? Of course not. But underwriters are going over every file with a fine tooth comb these days and having your information at the tip of your fingers can iron out a small wrinkle before it becomes a giant speedbump.

During a typical 30-day escrow period, there is ample opportunity for a potential home buyer to unwittingly sabotage his or her deal. Until the keys are in the buyer's hands, there are still several things that can cause a deal to unravel, even at the very end. Let's take a quick look:
Credit Issues: These days, a buyer's credit is monitored until the end. Not only will the lender find out if a new account is opened, but also if anyone else even inquired into the buyer's credit after the lender's credit inquiry. If the new furniture will require financing, best bet is to wait until the loan is closed. If the new home's garage is incomplete without a new car, wait until the loan is closed!
Employment: Changing jobs during an escrow is always an obvious no-no. But sometimes internal changes can destroy the deal. Examples include being switched from an employee (w-2) to an independent contractor (1099), or compensation switching from salary/hourly to commission. And lenders will call to verify that the buyer is still gainfully employed right before they hit the big "fund" button.
Assets: Many conventional loan programs require a minimum amount of assets or reserves in the bank. Although FHA and VA loans do not have minimums, some loan approvals are given based on compensating factors such as money in the bank after closing.
A loan may be approved based on an older bank statement with a certain amount of cash in the account. However, the approval might require that the most recent account statement be provided. If the new balance is lower, this could jeopardize the loan approval EVEN if there is still sufficient money in the account to cover down payment and costs.
I think every loan officer has had a loan die, or have a closing significantly delayed, from one or all of the above. Properly prepping buyers at the beginning helps, but sometimes you can only do so much. Have to admit, these things keep the industry interesting.
Yes, it is a full documentation lending world these days. That being said, the more prepared you are at the time of your initial loan application, the faster and smoother your transaction can go. The following is a list of items that may be required:
Copies of Federal tax returns personal and corporate (1040, 1120, 1120S, etc.) including all schedules for 2009 and 2010 (2008 if 2010 not yet filed). If corporate, include copies of K-1's as applicable.
Copies of w-2's and/or income 1099's for 2009 and 2010
Copies of paystubs covering the most recent 30-day period. If paid monthly, 2 consecutive paystubs will be required.
If income or pension is received, copies of Awards letters.
Copies of most recent 2 months bank statements (all pages), 401k, IRA, brokerage accounts, etc. (assets)
For real estate owned, copies of recent mortgage statements or coupons, homeowners insurance declarations pages, property tax bills, and HOA statements as applicable.
Copies of valid driver's licenses or other government issued picture ID's and social security cards
For permanent resident aliens, copy of current Green Card. For non-permanent resident aliens, copy of current work visa.

Yes, this is a lot of information. But the Wild West of Lending is behind us now. As the Boy Scouts say, "Be Prepared!"
I will be the first to admit that I did not want to sit at an Open House on Sunday for three hours when I was asked on Friday. Another lender backed out at the last minute, so the broker called me to see if I wanted to do it. The agent that would be there is new to the area and trying to establish himself here.
The list of excuses of why I could not do it immediately came to mind. Sunday is for football, not for sitting at an Open House. This is San Diego and the sun will be out. The ocean will be warm. I have so many other things to do. But, this broker is one of my biggest supporters so I told him I would check my schedule and call back.
After 30 minutes, I called back and said, "I would love to."
Good thing. Within 10 minutes of opening, we had already had 5 couples come through. By the end of the day, a total of 20 people had walked in, for a Carlsbad home that has already been on the market for 26 days. Pretty good for a beautiful, sunny, football afternoon.
Turns out that the agent didn't want to do the open house either, kind of a necessary evil. The best part was that the agent and I came up with a plan for some joint marketing in the Aviara area of Carlsbad, a plan that we would not have come up with on our own.

We are fast approaching the deadline for the current High Balance Conforming (Fannie Mae) and Super Conforming (Freddie Mac) loan limits. Effective October 1, 2011, these temporary limits are dropping in many areas including San Diego County.
The current loan limit in San Diego County for single family purchases and refinances is $697,500 for Fannie, Freddie, and FHA loans. However, it is dropping to $546,250. In Los Angeles, Marin, and Orange Counties the current limit of $729,750 is dropping to $625,500.
This information is not new. However, different lenders have set different cut-off dates for taking in loans under the current limits. Some have actually already stopped accepting loans that exceed the limits that will go into effect on October 1st.
AmeriFirst Financial is still accepting these loans and will do so until mid-September. However, all loans under the "old" limits must close by September 30, 2011. NO EXCEPTIONS.
So, if you are purchasing or refinacing a home in California and having trouble with your lender because your loan amount will be too high after 9/30, give me call. I can probably help.

Many borrowers have assets, but their income is not sufficient to qualify for a loan. Maybe the borrower is self-employed and their tax returns do not indicate enough. Or maybe the borrower is recently retired has had a dramatic income reduction. Asset Depletion is a way for an underwriter to use a borrower’s assets to provide more income to qualify.
After all, the borrower’s assets are in an income bearing vehicle, like checking, savings or money market accounts, or stocks, bonds and mutual funds…the assets are working for the borrower and generating income. We can use those assets to help the borrower qualify.
Although this makes perfect sense, it is highly irregular for an underwriter to approve a borrower using assets as income. However, our underwriters understand the logic in approving a borrower who has demonstrated their ability to save and accumulate assets. Asset Depletion is simply an Underwriter’s tool to apply more qualifying income by calculating a return on the borrower’s “liquidable” assets.
EXAMPLE 1: 43-YEAR OLD BORROWER:
ØBorrower’s income is $5,000/month but DTI is too high to qualify.
ØBorrower has $1,000,000 in liquid assets.
ØThe underwriter uses Asset Depletion to help with the DTI by running a mortgage calculation at 5% over a 30 year amortization on the borrower’s $1,000,000 assets. Why a 30-year amortization? Because the borrower’s age (40) subtracted from 85 is more than 30 years.
ØCalculation: $1,000,000 at 5% over a 30-year amortization:
Result: $5,368/month additional income for qualifying purposes…put this on the 1003 under “Other Income”. This amount is added to his existing $5,000 income so now he has $10,368/month for qualifying purposes.
EXAMPLE 2: 73-YEAR OLD BORROWER:
ØBorrower’s income is $5,000/month but DTI is too high to qualify.
ØBorrower has $1,000,000 in liquid assets, including a retirement account.
ØThe underwriter uses Asset Depletion to help with the DTI by running a mortgage calculation at 5% over a 12 year amortization on the borrower’s $1,000,000 assets. Why a 12-year amortization? Because the borrower’s age (73) subtracted from 85 equals 12 years. This gives a more favorable calculation for the borrower.
ØCalculation: $1,000,000 at 5% over a 12-year amortization:
Result: $9,250/monthadditional income for qualifying purposes…put this on the 1003 under “Other Income”. This amount is added to his existing $5,000 income so now he has $14,250/month for qualifying purposes.
CALCULATION SPECIFICS:
For use on a mortgage calculator such as an HP 12C…it’s a simple mortgage calculation:
Step 1.Determine the Present Value of the Assets: the total amount of eligible assets, less down payment, less required reserves of 12-months total debt service (PITI on the subject property plus all other payments including auto, credit cards, and other mortgage payments).
·Eligible assets must be cash or cash equivalent, trust funds, investment portfolios (stocks, bonds, mutual funds), and retirement accounts only if the borrower is of retirement age (62).
·Ineligible assets include retirement accounts if the borrower is not of retirement age (62), equity in REO, and private stock.
·No double-dipping…if your borrower is already receiving income from the assets which is reflected on the 1003, then you may not use Asset Depletion on those same assets.However, if the amount currently received is less than calculated with the above formula, the difference may be added (case by case basis).
Step 2.Rate: always use 5% - we could use a higher rate if it was necessary and with evidence that a higher rate is warranted.
Step 3.Amortization: subtract the borrower’s age from 85 and use that as the amortization period but no more than 30 years and no less than 10 years. For example, if the borrower is 61 years old, then the amortization period is 24 years (85-61). If there is more than one borrower, then use the borrower whose name appears on the asset account. If both borrowers’ names are on the asset account, then use the lower age.
Step 4.Resolve for Payment and include on the 1003: the resulting number is then added to the existing income for DTI purposes ��" on the 1003 under “Other Income”.
NOTES:
üThe target DTI is always 40%.
üAsset Depletion can be used on any scenario, at any LTV, and with any product…there is a pricing adjustment applied. Asset Depletion may be used for Foreign Nationals on an exception basis, but in that case the assets must be in U.S. accounts.
üAsset Depletion can be used together with Pledged Assets which I will talk about in another post...

If you were paying attention to mortgage rates this week, then you witnessed one of the wildest rides in quite some time. Here is a quick blurb from MSBQuoteline:
"In one of the most volatile weeks ever seen, important economic news came out every day and produced major reactions in financial markets. Investor uncertainty is extremely high, amplifying the price movements. As stock prices fluctuated wildly, so did mortgage rates, which reached new lows for the year.
Into this highly charged environment, a steady flow of significant economic news added fuel to the flames. It began late last Friday with the announcement that S&P downgraded the credit rating of US debt. Then the Fed shocked investors with its statement (see below). A scare ran through financial markets that European banks, particularly in France, were at risk of failing, but these fears abated quickly. Investors were comforted by very strong demand for the 3-year and 10-year Treasury auctions, and then were taken aback by extremely poor results for the 30-year auction. It is not surprising that many financial markets set volatility records this week.
The biggest surprise in Tuesday's FOMC statement was that the Fed currently anticipates that economic conditions will call for the fed funds rate to remain exceptionally low through at least the middle of 2013. The Fed also downgraded its forecast for economic growth, saying that it will be "considerably slower" than previously expected at the last FOMC meeting on June 22. Slower economic growth with few signs of higher inflation will make it more difficult for the labor market to recover, but it is a favorable environment for mortgage rates."
There was a short period yesterday when a FHA 30 year fixed rate of 3.875% was available for ZERO points. That is borderline ridiculous! Let the good times roll.

So, you want to purchase San Diego County real estate. You and your real estate agent have scoured the neighborhoods for the right size home, the right schools, maybe even a community pool. For what you want, maybe the prices are in the low- to mid-$700's. You have 3.5% down payment, or 5% down payment, or even 10% down payment.
Guess what...if you do not close by September 30, 2011, you will not be able to purchase that home without a full 20% down payment. Why? Because the current High Balance Conforming (Fannie Mae), Super Conforming (Freddie Mac), and FHA Jumbo loan limits are dropping from $697,500 to $546,250 for San Diego County loans that close October 1, 2011 or later.
Nationally, the loan limit drop is expected to have a minimal effect on housing. However, about one fifth of my monthly closings exceed this new lower loan limit.
And, even if you have 20% down payment, but your loan exceeds the new lower limit of $546,250 you will most likely pay a higher rate than you would today for the same loan balance. That is because any loan amount that exceeds this number will be considered a true Jumbo loan, thereby carrying higher rates and usually more strict qualifying guidelines.
Other "High Cost" areas, such as Los Angeles, San Francisco, and Orange County CA, currently have high balance and FHA Jumbo loan limits of $729,750. These limits will be dropping to $625,500.

The main focus this week was the June Employment report. Rising expectations during the week pushed mortgage rates higher ahead of the report. But when the Employment data came in far below expectations, mortgage rates improved significantly and ended the week a little lower.
Against a consensus forecast of 125,000 new jobs, the economy added just 18,000 jobs in June, the lowest level since September 2010. The figures from the prior two months were revised lower by 44,000. The Unemployment Rate rose to 9.2% from 9.1% in May.
Average Hourly Earnings, a proxy for wage growth, were unchanged from May, below the consensus for a rise of 0.2%. In short, economic bright spots were hard to find.
Following a series of stronger than expected economic reports in recent weeks, the Employment report was a surprise. The question for investors is how much weight to place on this report in determining the economic outlook.
Does this mean that the economy is recovering more slowly than previously thought? Or is it that the jobs data simply operates with a small lag? There is little doubt that the US economy slowed during the first half of the year, primarily due to rising oil prices and the Japanese earthquakes.
The impact of these obstacles was expected to be temporary, and nearly all the economic data in recent weeks appeared to support this. This Employment report will certainly make investors more cautious about the pace of future economic growth, but they will not overlook the wide range of other data which suggests that growth is accelerating. With mortgage rates at such low levels, solid evidence of a sustained deterioration in growth likely will be needed for rates to move much lower.
That being said, highly qualified buyers are still seeing 30 year fixed rate mortgages in the mid-4's. True Jumbo financing has also been priced very aggressively recently as more "players" are entering that market.

The commission came in handy for some new carpet, plumbing, and paint.
Selling homes does not float my boat and I realized that a long time ago. I do mortgage loans...period! Heaven knows why, but there are still some that are trying to sell real estate and mortgage loans. How can anyone keep up with both sides of the industry these days?

A lot of people have rough credit right now, whether from the economy, loss of job, previous marriage, you name it. Some newly married couples (and some not so newly married) are having trouble buying a home together.
Maybe the wife is employed and the husband is unemployed, but he has a large car payment with no income to offset. The obvious choice is to remove one of the spouses from the transaction if the remaining spouse has enough income.
HOWEVER: If the new loan will be an FHA insured mortgage in a Community Property State like CA, the Debts of the non-purchasing spouse must be included in the debt to income ratios.
Fortunately, the purchasing spouse is no longer penalized if the non-purchasing spouse had a short sale or foreclosure prior to their marriage. The non-purchasing spouse's credit scores are not factored into the loan decision.
Keep in mind that if the non-purchasing spouse refuses to give consent for the credit report then the loan will not be eligible for FHA insured financing. Good to know this information upfront before you get too far into a transaction. Some rookie lenders are unaware of these guidelines...

Fannie Mae announced new guidelines regarding deferred installment debts, namely deferred student loans. The FNMA Selling Guide currently requires deferred installment debts to be included in the debt-to-income ratio.
Prior to FNMA's change, if the borrower's credit report did not indicate the future monthly payment, lenders were required to obtain a copy of the borrower's payment letter or forbearance agreement. The future payment would then be counted against them for qualifying.
However, FNMA is now making an exception to this policy for deferred student loans. The lender may now calculate a monthly payment based on 2% of the balance of the student loan in lieu of obtaining documentation of the monthly payment ONLY IF the credit report does not contain one. The actual payment can be used if documentation is provided.
This new policy actually makes sense! Surprise surprise!
We have heard that the current FHA Jumbo loan limits and Fannie/Freddie High Balance Conforming and Super Conforming loan limits will decrease after September 30, 2011. FHA finally put it in writing in their FHA Market Analysis Brief released last week.
In the article, FHA mentions that there are 669 potentially affected counties and county equivalents (major metropolitan areas). The smallest decreases will occur in four Ohio counties (Greene, Miami, Montgomery, and Preble) and one Texas county (Jeff Davis). These counties will see their maximums drop from $271,250 to $271,050. Seriously...?
However, the majority of "high limit" counties in Puerto Rico will drop by $221,000 from $606,250 to $385,250. The largest decrease ($250,750) will occur in Hawaii County from $618,750 to $368,000. California's Monterey County is a close 2nd with a potential decrease of $246,750 (from the current national maximum of $729,750 to $483,000).
For those purchasing a home using FHA insured financing in San Diego County after October 1st, 2011, the limit will drop by $151,250 down to $546,250 from the current level of $697,500. Although the percentage of CA FHA insured loans from 2010 that would have been affected is only 6%, the dollar volume that would have been affected would have been over $4.2 billion.
Personally, I close one FHA Jumbo in San Diego County for every four FHA conforming loans I close. Of those, about one out of four exceeds the potential new limit of $546,250. It will be interesting to see how this all unfolds as we approach the September 30th deadline.

Your Loan Mod Looks Good, Only A Couple More Weeks For A Decision
True story. A couple of past clients of mine had fallen on hard times and did not have the equity to do a "regular" refinance. Furthermore, their loan is not Fannie or Freddie. So, after they missed a mortgage payment, their lender BIG BANK sent them a package regarding a possible loan modification.
They figured, "what have we got to lose by sending in the paperwork?" So they gathered two years tax returns, last 30 days of paystubs, last 2 months bank statements, a letter of explanation of why they fell on hard times, and completed the application form.
They overnighted the documentation back to BIG BANKS's loan mod department on May 6th, 2010. After two weeks, they called to make sure the information was received. It was and they were told to call back in another couple of weeks.
They called back as instructed and were told that they were missing basically all of the paperwork that was originally sent in. So they faxed it to the loan mod department this time and were told to call back in a week. They also received another package re: a loan mod with BIG BANK.
This cycle continued until November 30th, 2010, when they received a letter stating that all of their items had been received and that a "decision" would be given within 30 days. They called at 30 days, 45 days, 60 days, 75 days, 90 days..."it's still in line for a decision."
During all of this time, they were given conflicting information by the BIG BANK regarding their payments. Some days they were told to keep paying, other days they were told not to pay. Money was tight so they did not keep paying. Better to put food on the table.
Finally, they received a letter on April 16th, 2011, via Fed-Ex that stated, "You do not qualify for a loan modification and foreclosure proceedings will begin on May 16th, 2011." The letter really did not list why not, just not. However, it did show what the modified payments would have been if approved...thanks for the carrot.
Fortunately for these folks, a family member came to their aid and brought the mortgage current prior to the "deadline" set by the BIG BANK. Moreover, their employment situation has improved and they are now able to handle the non-modified payment. But, the last 10 months was the most stressful period of time in either of their lifetimes. Pretty sure BIG BANK didn't have any trouble sleeping.
We have seen a nice drop in rates over the last few weeks or so, roughly 0.375% on 30 year fixed rate Conforming loans (up to $417,000) and 30 year fixed rate High Balance Conforming loans ($417,001 to $697,500 in San Diego County). This drop equates to an increase in buying power and an increase in buying options.
Increased buying power, two examples:
· A payment of $2,112 at 4.875% equated to a loan amount of $399,050. Same payment but at 4.50% equates to a loan amount of $417,000. Price range increase of $17,950.
· A payment of $3,638 at 5.125% equated to a loan amount of $668,150. Same payment but at 4.75% equates to a loan amount of $697,500. Price range increase of $29,350.
Increased buying options:
Let's say you were already going to borrow $417,000 or $697,500. The recent reduction in interest rates would lower your payments by $95 at $417,000 and almost $160 at $697,500. This loan payment reduction might now allow you to look at communities with amenities such as a community pool, tot lot/playground, and common ground landscaping; amenities that many families are looking for but were unable to afford due to the $50 to $100 additional Homeowner's Association (HOA) fee. The lower mortgage payment now leaves room for that HOA fee. This gives you more properties from which to choose.
Are lender's guidelines stricter now than a few years ago? Yes, of course. However, buying opportunities are still abound. The real question is: Are you ready to take advantage of this market? As author Paul Fargis once said, "Luck is when preparation meets opportunity." Be lucky. Be prepared. Get pre-approved today, and be ready to take advantage of that opportunity when it comes around.
During a typical 30-day escrow period, there is ample opportunity for a potential home buyer to unwittingly sabotage his or her deal. Until the keys are in the buyer's hands, there are still several things that can cause a deal to unravel, even at the very end. Let's take a quick look:
Credit Issues:
These days, a buyer's credit is monitored until the end. Not only will the lender find out if a new account is opened, but also if anyone else even inquired into the buyer's credit after the lender's credit inquiry. If the new furniture will require financing, best bet is to wait until the loan is closed. If the new home's garage is incomplete without a new car, wait until the loan is closed!
Employment:
Changing jobs during an escrow is always an obvious no-no. But sometimes internal changes can destroy the deal. Examples include being switched from an employee (w-2) to an independent contractor (1099), or compensation switching from salary/hourly to commission.
And lenders will call to verify that the buyer is still gainfully employed right before they hit the big "fund" button.
Assets:
Many conventional loan programs require a minimum amount of assets or reserves in the bank. Although FHA and VA loans do not have minimums, some loan approvals are given based on compensating factors such as money in the bank after closing.
A loan may be approved based on an older bank statement with a certain amount of cash in the account. However, the approval might require that the most recent account statement be provided. If the new balance is lower, this could jeopardize the loan approval EVEN if there is still sufficient money in the account to cover down payment and costs.
I think every loan officer has had a loan die, or have a closing significantly delayed, from one or all of the above. Properly prepping buyers at the beginning helps, but sometimes you can only do so much. Have to admit, these things keep the industry interesting.

The FHA mortgage insurance premium increase date is fast approaching. Today is April 6th and you must have an FHA case number assigned prior to April 18th to avoid the increase. Read more: FHA To Increase Mortgage Insurance Premiums.
HOWEVER!!!!! The FHA Connection, the online engine that lenders use to access FHA case numbers, etc, is not available on the weekends. So, April 15th is the actual date!!! Is your lender aware of that or does he/she say things like, "my processor handles those kinds of things, they'll take care of it Monday."

I wrote a post late last year regarding one of the possible disadvantages of waiting to buy called Rate Vs. Price Reduction. It was short but sweet so here it is:
"Since the Fed's Mortgage Backed Securities purchase program ended, the markets have seen much more volatile price swings...and rates overall are off their lows. For potential buyers who are waiting to see if home prices come down a little more, that means the wait could cost more money in the long run.
Here is an example: Let's say a home buyer finds a home that he likes for $400,000. The buyer wants a better deal on the home, so he waits until the price has dropped by $10,000. However, during that waiting period, rates increase from 4.25% to 5.00%.
If the buyer planned on putting down 20%, the monthly payments at the lower amount but the higher rate would be about $100 more per month. Over the life of the loan, this buyer would actually pay $36,000 more in interest all to save $2,000 upfront (the difference between 20% of $400,000 and 20% of $390,000).
These are of course just examples. However, home prices are already very affordable...and rates are still low for now - but they did go up anywhere from 0.25% to 0.50% depending on the product in the last couple weeks. In the end, waiting for a home price to reduce may end up costing a buyer much more in the long run."
What do you know, rates clipped over the 5% mark for a bit, although lower now, but FHA is increasing the annual mortgage insurance premium (paid monthly) effective for FHA case numbers assigned on or after April 18, 2011.
This is the same as an interest rate increase! Keep waiting...
