Description: The  Pieter Claesen Wyckoff House Museum is said to be  the oldest home in New York City. The house, built around 1652, became the City's first landmark in 1965. The original owner Wyckoff was a magistrate, successful farmer, and one of  the wealthiest citizen of New Amersfoot, which later became the town of Flatlands. Wyckoff's descendants lived in the house until 1901. Currently  the site is a property of New York City  Department of Parks & Recreation, and the house is a museum. New York City- HP Proceeding

New York City tenants if your landlord has failed to make much needed essential repairs, you may have to file a HP proceeding to force the landlord to make repairs and correct building  violations. 

A tenant can bring a case against a building owner in Housing Court to get an order to correct the conditions. This case is called an HP Action.  An owner's failure to make  repairs or provide  important services may be a violation of the New York City Housing Maintenance Code or the New York State Multiple Dwelling Law. In an HP action, a judge can order the building owner to correct the violations. To start an HP proceeding against your building owner, go to the Clerk's Office at the Housing Court in the county in which your apartment is located.  There you will be givena form  called an "Order to Show Cause Directing the Correction of Violations-  you should list all the conditions that need to be addressed in each room of your apartment and public areas in the building. You do not need a lawyer to start an HP case. For more information about HP actions, visit the website of the New York State Unified Court System.

Brooklyn homebuyers what is NYC Participatory Budgeting program

New York City Participatory Budgeting Program

 

The Participatory Budgeting program allows residents to  help develope and vote on proposals for  capital improvement projects in their district- funds  come from local  city council members  discretionary funds.  Currently in New York City four council members  districts are using  this progam.  Brooklyn- Jumaane D Williams (D Flatbush)  and  Brad Lander (D Park Slope) , Manhattan - Mark Viverito, Queens- Eric Ulrich.  Meetings are open to residents  of the participating districts and the final vote will take place in March of 2012 where residents will vote on which projects to fund. 

This program allows residents to participate  and be active in how their tax dollars are spent.  So when you are looking to buy Brooklyn Real Estate its a great option  to consider whether or not you will have a direct impact in terms of how some city council  discretionary funds are spent in your community.

A Home Equity Conversion Mortgage (HECM) is a FHA Reverse  Mortgage.

A reverse mortgage is a loan that lets the owner convert some of the equity of their home into cash.  This equity will be paid to the home owner.

What is NYC Senior Citizens Rent Increase Exemption Program (SCRIE)?

If you are a Brooklyn, NY senior citizen who needs help with your rent, you may want to apply for SCRIE.

What is NYC 421A exemption?

The 421A exemption promotes Multi-family Residential construction.  It provides a declining property tax exemption based on the new value created.  The program is administered by the NYC Department of Housing Preservation and Development and the Department Of Finance.

The 421A varies depending on location, method of construction and if requirements for affordable housing has been met.

HPD determines eligiblity .  Department of Finance administers the benefits.

Brooklynites would you like to know your home solar energy potential

New York city in partnership with the City University of New York will launch a new online interactive solar map system- to show solar energy potential for every building in New York City.

Researchers flew planes in a grid pattern over the city and laser charted points, creading a 3-D map of the city's  five boroughs buildings.

The interactive tool will allow users to estimate solar energy potential for any building in the city.  The map will display realtime solar energy production citywide and allow users to estimate the cost for investing in solar.  Homeowner will be able to enter their address and find out how much energy their roofs could capture.

NYC Clothing Recycling Program for Apartment Buildings

 

                                                           RefashioNYC

 

RefashioNYC is a program that provides participating  apartment buildings with  used clothing bins drop off services at not cost to the building or tax payers.  Joining the program only requires the buildings landlords, managers and superintendents to monitor the used clothing bins and notify Housing Works, the City's Partner when the bin is full.  Using these bins will help divert this type of waste from our landfills. The used clothing will be used by Housing Works  to fund services for homeless and low income New Yorkers. This program was launched by NYC Department of Sanitation as part of its recycling program.

Obama Administration Offers Assistance to Unemployed Homeowners

 

On Thursday July 7th, 2011 according  to  www.hud.gov starting August 1, 2011 the Federal Housing Administration will extend the period for unemployed homeowners to miss mortgage payments to a full year.  The administration also request that  HAMP (Home Affordable Unemployment Program) servicers also extend the forbearance period to 12 month.  .  This program will let qualified unemployed  Brooklyn homeowners  go without making monthly mortgage payments for 12 months before servicers can begin the foreclosure process.

What is the Difference Between Rent Control and rent Stablization?

 

Rent Control

The rent control program applies to rsidential buildings constructed before February 1947 in municipalities that have not declared an end to the postwar rental housing emergency.  There are 51 municipalities that have rent control including New York City.  For an apartment to be under rent control, the tenant (or their lawful successor such as a family member, spouse, or adult lifetime partner) must have been living in that apartment continously since befor July 1 1971.  When a rent controlled apartment become vacant, it either becomes rent stabilized, or if it is in a building with fewer than six units, it is generally removed from rent regulation.

An Apartment in a one or two family house must have a tenant in continuous occupancy since April 1, 1953 in order to be subject to rent control.  Once it is vacated after that date it is no longer subject to regulation.  Previously controlled apartments may have been decontrolled on other grounds.

Rent Stabilization

In NYC rent stabilized  apartments are those apartments in buildings of six or more units built between February 1st 1947 and January 1 1974.

Tenants in buildings of six or more units built before Feb 1, 1947 and who move in after June 30, 1971 are also covered by rent stabilization

There  is a category of rent stabilized apartments where buildings with three or more apartments constructed or extensively renovated since 1974 with special tax benefits.  These buildings are stabilized only while the tax benefits continue.

There are some exceptions- refer to  New York State Division of Housing and Community Renewal at 718-739-6400

New York City rent stabilization system was enacted in 1969 when rents were rising sharply in many post war buildings.  rent stabilized tenants are protected from sharp increases in rent and have the right to renew their leases.  The Rent Guidelines Board sets allowable percentage increase for renewal of leases each year.

What is Home equity conversion Mortgage for Seniors (HECM)

 

A Home Equity  Conversion Mortgage (HECM) is a FHA reverse mortgage

A reverse mortgage is a loan that lets the owner convert some of the equity of their home into cash.  This equity will be paid to the home owner.

Some of the requirements- The home owner must be 62 years or older, own the home, or if there is a small mortgage it can be paid off at the closing with proceeds from the reverse loan.  The home owner must live in the house.

Types of homes eligible for FHA HECM

Single 1-4 , the owner has to live in one of the units, HUD approved condo and manufactured homes that meet FHA requirements.

Loans must be paid in full when the owner dies or sells the home.

Loans can be called if the owner is considered in violation of certain terms such as failure to pay property taxes or hazard insurance, move to a new principal home, or allow the property to fall into disrepair.

Thinking of A Short Sale get to know these terms

 

If you are thinking of  a short sale you should understand the type of loan that you have and get familiar with the following terms.

 

Recourse loans- lenders are allowed to go after you for the balance that you owe, even if they have taken your home

Non-recourse loand- lenders can not pursue you for additional funds due.  If they foreclose on your home, lenders can not seek further legal actions against you.

Deficiency Judgement- a court order that makes you liable for an unpaid debt.

Right of redemption- requires you to pay the full outstanding loan, including interest and other charges

Lis pendens- a legal notice that a law suit has been filed concerning title to a specific property
