New HARP refinance plan from the government announced

New HARP refinance plan from the government announced.

Here is some info on that new refinance plan that is coming out of the White House. It basically is offering people a chance to refinance their home no matter how far it is upside down. But there are conditions to it and its “voluntary”, meaning the banks don’t have to do it or they can add their own restrictions to it as well. So it’s not going to be a cure-all. The loan to be refinanced has to be held by Fannie Mae or Freddie Mac. Still no hope for the “Pay-Option” people.

What You Need To Know About Short Sales

What You Need To Know About Short Sales What You Need To Know About Short Sales

Sellers’, listing a short sale is like your first visit into the wild jungle.  There are pit falls to beware of, trails that lead you nowhere, and no one to help you find your way out.

Real estate agents bring a little stability to the transaction, but a short sale’s success depends on a variety of variables.  This type of transaction is constantly evolving; however there are a few things that remain the same, and that every seller and their agent needs to know when working with short sales.

What You Need To Know About Short Sales. Market Value Matters. Short sales sell for market value.  That’s right.  A bank will typically agree to a short sale if the numbers make sense.  Banks understand that homes need to appraise.  Banks also need to mitigate their loss. What You Need To Know About Short Sales

Listing your home for well below market value is not the best strategy for getting your short sale accepted.  Sure, you may get plenty of offers, but if the bank won’t accept any of them you end up having wasted a ton of  energy, not to mention paper, and facing quite a few angry potential buyers.

What You Need To Know About Short Sales. Banks are no longer in the business of giving away houses.  If you send the bank numbers that make sense, you increase your likelihood of a successful short sale closing by 90%.

What You Need To Know About Short SalesWhat You Need To Know About Short Sales. Only Real Hardships Get the Help .I’ve lost count of the number of times potential sellers have told me the only reason they are pursuing a short sale is because everyone else is doing it. Purchasing a house during the housing boom is not a legitimate hardship.  Purchasing a house during the housing boom and being unable to pay your mortgage is a hardship.

What You Need To Know About Short Sales.Sellers’, planning a strategic default is not the thing to do! Banks actually analyze short sale sellers’ hardships, and most center on the economy, so the bank is going to make sure that a short sale is in their own best interest.  Acceptable hardships include medical issues, divorce, and disability, significant loss of income, death, unemployment, and relocation.

What You Need To Know About Short Sales. Laws are local. It’s important that you know your state’s foreclosure laws because there are currently no national short sale laws on the books.  There are federal guidelines, but they can be applied when and how a bank wants. States, however, can either have recourse loans or non-recourse loans.  A recourse loan allows the bank to demand a borrower pay the difference between what the properties is sold for and what is owed on the lien. What You Need To Know About Short Sales

What You Need To Know About Short Sales. Many recourse states allow lien holders (banks) to pursue judgment liens against the borrower for the deficiency amount.  This process allows the bank to garnish a borrower’s wages until the debt is paid off.  Garnishments can be as much as 25% of non-exempt disposable earnings, and bankruptcy doesn’t always save a defaulted borrower from judgment liens.

With the exception for California of a newly implemented bill SB 458 "SB 458 (Corbett) Anti-Deficiency – C.A.R .initially sponsored SB 458 to revisit the “anti-deficiency” issue of SB 1178 (Corbett, 2010), which was vetoed by Governor Schwarzenegger. As introduced 458 would have extended existing anti-deficiency protections to cover the refinance of purchase money mortgages, and new debt (cash out) incurred to acquire, construct or improve the home. C.A.R. and the lender groups reached an agreement to amend SB 458 to instead expand the provisions of existing law (SB 931 of 2010) which became effective this year. SB 931 requires a first mortgage holder to accept an agreed upon short sale payment as full payment for the outstanding balance of the loan, but does not apply to junior lien holders.

SB 458 extends the protections of SB 931 to junior liens effectively providing that any lender that agrees to a short sale must accept the agreed upon short sale payment as full payment of the outstanding balance of all loans.  In addition, this measure will clarify that this rule applies only to residences. " signed into office by Gov. Jerry Brown on July 15, 2011

What You Need To Know About Short Sales

What You Need To Know About Short Sales. Now remember your Real Estate agent is not allowed to practice law unless he or she is licensed  to do so. However, agents do need to be aware of possible penalties for short selling a home and also be able to direct you their clients to the right resources to discuss the possible consequences and solutions. Short sales, just like the jungles can be scary to navigate. That’s why it can pay to know the perils that lie around each bush, before listing your home as a Short Sale. If you do, there can be some much-needed relief for you and help you know. What You Need To Know About Short Sales.Credit:Trulia...What You need To Know About Short Sales

How to Remember Names

How to Remember Nameshow to remember names

"If you want to win friends, make it a point to remember them. If you remember my name, you pay me a subtle compliment; you indicate that I have made an impression on you. Remember my name and you add to my feeling of importance." - Dale Carnegie

How to Remember Names, it seems so simple, but sometimes it's so hard...  Have you ever run into an old client at the grocery store and you just can't remember their name?  It's right at the tip of your tongue but you just can't grab it. It's an awful feeling which usually results in a quick cover up like "So, How's the house?"  Recalling names is one of the most important pieces of our business.  The problem is that we often times have so many things going on that we simply don't concentrate on setting up a system for remembering the names of everyone we meet each day.  I've included below an article with some neat tricks  on how to remember names, keep in mind if this is something that you occasionally struggle with.

It is certainly not uncommon to forget a name of someone you once did business with, nor even someone that you just met, but there are steps you can take to improve your recollection of how to remember names.

how to remember names

How many times have you been introduced to someone only to forget his name as soon as you have shaken hands? Most of the time, we "forget" names because we never stored them properly to begin with, not because we cannot recall them.A normal introduction goes something like this:"Hi, my name is Tom Smith," returned with, "Nice to meet you. I'm Greg Matthews." There's nothing difficult about how to remember names  Tom and Greg, but the problem is that, while Greg is giving his name, Tom is thinking about what he is going to say next. The name is not set to memory, and Tom leaves the meeting having no idea of who he just met.In addition to being frustrating and embarrassing, forgetting names can end up costing you in your professional life.Business referrals, clients, customers, and patients all want to feel significant.

When you take the extra care to notice and remember a person, calling him or her by name, you are showing that they matter to you. This also gives you an edge over your competition. Let's take a look on how to remember names better.

 1) Pay attention, it will help you on how to remember names.Obvious, right? You'd be amazed at how little attention we pay to the person we are meeting. Be present in the moment and listen when your new acquaintance says her name. Clear your mind and focus on him/her - not on what you're going to say next.

how to remember names

 2) Repeat the new name. Say it right back to the person.John: Hi, my name is John. You: John, nice to meet you. Then, try to use the name two more times before parting. An excellent way on how to remember names is to introduce the person to one or two others.

3) Ask for the spelling. If the name is not familiar to you - foreign or otherwise unique - get its spelling to reinforce your understanding and to confirm you have heard the name correctly. Many people are hesitant about asking for the spelling or just asking the person to say his name again, don't be it will help you learn how to remember names. . People like it when you take an interest in them, and they're happy to repeat their name if it means you're actually going to remember it (and use it in the future). Some people have heavy accents, and some have really unusual names. These people often have their names forgotten or mistaken. Imagine the impression you'll make when you take the time to truly understand their name, get the pronunciation correct and remember it.

how to remember names

4) Pick out distinctive features. When you meet someone, spend time looking at their face, and pick out a distinctive feature. Notice a crooked nose, puppy dog eyes, a cleft chin, big ears, yellow teeth etc. If possible, pick out the feature before you're introduced so you're not struggling to find one while the person is giving you his name. When you focus on the particular feature, your brain naturally associates it with the name. This will take a little time, so begin by studying people on the street, in restaurants, on the subway etc. With practice you will train your brain to automatically pick out the outstanding feature of each face and learn how to remember names.Note:Make sure you use permanent features and stay away from things like hair color, glasses, braces and things that may change over time.

how to remember names

5) Associate the name with a famous person. Another way of how to remember names is to associate them with famous people. If you meet Al, think of Al Capone, the Chicago mob boss. If you meet Jennifer, think of Jennifer Aniston. But don't stop there. In order to learn how to remember names, you need to associate it with an action.Picture your new client, Jennifer, sitting on the coffee house couch with Ross (from the T.V. show Friends). She goes to take a sip of her coffee when it slips out of her hand and spills all over Ross's new white pants. Make the picture as vivid as possible.(Smell the aroma from the coffee, and see the steam coming out of the cup. Picture a huge brown coffee stain on Ross's pants.) Now each time you see Jennifer, you'll recall the image and her name.

Start using these techniques one or two at a time until you begin to do them automatically. I saw a huge improvement from day one - of course that's coming from someone who could barely remember her own name at the time. I hope you enjoy these tips on. How to remember names.

6 Ways Not To Reset The Clock On Old Debt

6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt. Debt can turn into zombie debt

6 ways not to reset the clock on old debt

What do debt and milk have in common…….An expiration date!

Even if you've cried over spilled milk, chances are you haven't shed too many tears over expired debt. Yet unlike the milk in your fridge, you can accidentally revive old debt.

Please read on to discover a very simple way to avoid making a costly mistake

While state laws limit the amount of time debt collectors can chase you to pay debts or force collections through judgments and garnishments, some consumer mistakes can restart that clock.

Among them: acknowledging a debt, making a partial payment or ignoring a notice that a creditor is about to sue on an old debt.

Don't want to feel the bite of zombie debt? Here are. 6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt. Understand the two 'debt clocks'

6 ways not to reset the clock on old debt There are two debt clocks, and each is important.

First is the clock for forcing collections on a debt, which is often called the "statute of limitations on collections." It varies from state to state. Typically, it's three to six years. In some states, it can be up to 15 years. Please check your states, “statute of limitations on collections”.

This is the clock you have to consider if you're worried about reviving the possibility of forced collections on an old debt.

The second clock is the length of time a debt can stay on your credit report and, as a result, affect your credit score. That clock runs for seven years.

The credit-report clock on a delinquent debt starts six months after you stop paying per the National Consumer Law Center. No matter when the bad debt popped up on your credit report, it has to come off seven years after the clock started ticking. Nothing you or anyone says or does can restart this clock, per the National Consumer Law Center.6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt. Know the original default date

6 ways not to reset the clock on old debt

Seven years after the original default date all mentions of a debt -- no matter who has bought the debt or when -- have to come off your credit report, per vice president of public education for credit bureau Experian.

According to the Federal Trade Commission debt collectors can't change the account number and consider it a new obligation, and they aren't allowed to re-age the debt…..It must be seven years from the original default date

One exception is judgments. If a creditor sues and gets a judgment against you, they can keep the judgment on your credit report for seven years or until it expires. More times than not, credit bureaus keep the judgments on for the full seven years from the judgment filing date, because the judgment can have its own independent seven-year life span. 6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt.  6 ways not to reset the clock on old debtBe cautious discussing debt

When it comes to discussing old debt with a collector, it pays to be very careful.

The primary thing…..or most surprising thing….is that the statute of limitations can be restarted so easily… and by you, the consumer. All it takes is acknowledging the debt is yours, and you can restart your state's time clock on forced collections.

So what do you do if you want to discuss the debt because you need more information to determine if it is yours, or if you want to investigate payment options without restarting the collections clock? Ask questions in a  hypothetical manner.

For example:

  • "I don't believe this is my debt. Can you tell me more about it?"
  • "I'm not saying this is mine, but I'd certainly not like to talk to you anymore. What would it take to settle it?" 6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt. Proceed with that cease-and-desist letter

6 ways not to reset the clock on old debt

You are sick of debt collection calls. However, you're afraid telling the creditor not to contact you is an admission the debt is yours, well…..It's not.

You have the right to ask debt collectors in writing to stop contacting you, whether a debt is yours or not, and they have to comply. Simply send a letter identifying the debt, and tell them to stop contacting you about it.

"You're not affirming the debt -- you're exercising your rights under the Fair Debt Collection Practices.

Debt collectors are still required to notify you in writing if they are actually suing you, even if you send a case-and-desist letter. You don't lose the right to defend yourself in court.

But avoid those letters with multiple-choice boxes some collectors send. Often, you check one box to pay in full, one for a partial payment, and there's another to say it's your debt, but you can't afford to pay now. If you check a box and send it, it could be enough to serve as a written affirmation of the debt in some states. 6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt . Be judicious with payments 6 ways not to reset the clock on old debt

If you get an offer to pay "a little something" on an old debt, be wary.

Under many state statutes, a partial payment puts you back on the hook, for the entire debt and restarts the clock on forced collections..

It pays to do a little research before you agree to anything.

For people who have a lot of debt and are trying to decide which debt to pay and which to pay first, it makes sense for them to understand the statute of limitations issues so that they can make a rational decision on which debt they pay first.

If you have questions on the statutes in your state for various types of debt, the state attorney general's office or department of consumer affairs is often a good resource. The educated consumer is going to understand the issues and pay debts accordingly.

If you decide to pay it in full or negotiate a settlement for a lesser amount, get a written agreement beforehand acknowledging payment in full. That way, if the debt is later sold to a debt buyer, you'll have proof that it's been paid. 6 ways not to reset the clock on old debt.

6 ways not to reset the clock on old debt. Take legal action if necessary

6 ways not to reset the clock on old debt

If a creditor suing after the collections clock on old debt has expired? Take action.

Show the court the debt is too old, and you win automatically. However, that only works if someone tells the court the statute of limitations has expired. If creditors win a judgment on expired debt, they can force collection for as long as your state law allows.

It's up to you to go to court and raise the defense that the debt is beyond the statute of limitations. Don't trust the court system to figure it out on your behalf.

What you need to know: You must be legally served with notice of a lawsuit. Otherwise, you could move to set aside the judgment.

If a creditor gets a judgment on expired debt, you could have a countersuit under the Fair Debt Collection Practices Act. (Federal) courts have found that it's against the law to sue a consumer (over) a time-barred debt.  6 ways not to reset the clock on old debt.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy? How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

Here is an article that answers the question many Americans ask,

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

More consumers filed for bankruptcy or lost their homes in the last three years than ever before. Many are in line for a similar fate as the economy enters a double dip. In the end, consumers are left staring and wondering

The good news is a badly battered credit score isn't a life sentence. It will take seven to 10 years before your credit is better, unless you become delinquent again. Here is an outlines of how to fix your credit, starting with steps to take before your credit crisis.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

If default looks imminent, cushion the blow to your credit score by defaulting on just one account. "There is a component in the FICO score called prevalence. That means having five collections is worse than having one. Let the account with the highest monthly payment fall behind to free up more money every month to pay your other debt obligations. If you have to choose between debts to pay, skip the credit cards because it's unsecured and a creditor can't repossess anything. Credit card delinquencies hurt credit scores less than bigger debts i.e.; home or auto loans.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

If you can't mitigate the crash, don't worry. Take a breather after the event, before mapping out your entrance back into the world of credit.  If you have other outstanding delinquencies, catch up on those payments. If you still face looming debt out there, work on reducing it…the key is time. You won't be able to qualify for credit immediately, give it a few months.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

You need to know how to fix your credit using new credit accounts. A secured credit card is the first and only type of How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?credit available to someone with a blemished credit history. These cards require a security deposit, usually a minimum of $500, to activate it. The deposit is placed in a savings account, money market account or certificate of deposit. If you make on-time payments, your bank might convert the card to an unsecured card after a year. You need to make sure the issuer reports to the credit bureaus, otherwise, your efforts will be for naught. Make a call and ask if they report to all 3 bureaus….Very, Very important!

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

Another way to build your credit is to piggyback on someone else's card accounts. Ask a family member or your spouse to consider adding you as an authorized user on their credit card. You will benefits from the cardholder's payment history. So, make sure you choose wisely. A side note: Experian only includes authorized user accounts if the payment history is good.Checking with your bank or credit union to see if overdraft protection on your checking account is reported to the credit bureaus. Sometimes, it is considered an unused installment loan on your credit report.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

Lenders love to see recent good payment behavior, so pay your bills on time and keep balances low. Aim to pay off How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?credit card balances every month to keep debt from snowballing out of control. If you're a carrot-and-stick person, consider a credit monitoring service to keep you motivated. It's important to check your credit score periodically, especially when you're in the recovery phase.

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy?

Unfortunately, knowing how to fix your credit is only half the battle. The time it takes to rebuild your credit depends on the event and where you started. Borrowers with lower credit scores experience a smaller drop in their score after a huge credit event compared with those with great credit. If you get a mortgage modification after being delinquent on your home loan, it could take as little as nine months to lift a credit score of 625 to above 700 if all debts are brought current. I found this information from VantageScore.Stay on top of your new creditRestart your creditGive yourself timeAnticipate your credit catastrophe

How do I repair my credit after Foreclosure, Short Sale or Bankruptcy? The effects of foreclosures linger longer. Your credit score will start to rebound in as little as two years if you keep all other accounts in good standing. The road back from bankruptcy is longest, either seven years for a Chapter 13 bankruptcy or 10 years for a Chapter 7 bankruptcy. That doesn't sound good, but all is not lost."The severe impact from a bankruptcy occurs in the first two years and will roll off from there. If you consistently pay on time, in two to three years, you will get into a reasonable score range again.
